Restaurant patios get more time under AB 592

Some temporary outdoor alcohol-service approvals can continue longer, but a new patio still needs its own approval path.

Which deadline moved

AB 592 extends the expiration of California ABC’s COVID-19 Temporary Catering Authorizations from July 1, 2026, to January 1, 2029. ABC also says it cannot issue new authorizations of this type on or after January 1, 2027.

These dates concern a specific temporary alcohol-service authorization. They are not a blanket extension for every patio, sidewalk dining area, or construction permit.

For an existing restaurant

Find the actual authorization covering your outdoor service area. Compare the approved boundaries with the area you use today, and ask ABC about your authorization and the route to longer-term approval.

Also contact the City department responsible for outdoor dining. A state alcohol authorization and permission to occupy or build in a particular outdoor area answer different questions.

For a new restaurant or expansion

Before including patio seats in your business plan, have the design team map the area and identify the approvals it needs. Ask about the lease boundary, customer access, alcohol service, and any proposed construction.

Include the outdoor area in discussions with restaurant contractors. A bid that only covers the indoor dining room will not tell you what it takes to make the full concept usable. Keep the approval schedule separate from your hoped-for opening date until the agencies have reviewed the proposal.
